Lower House Approves Amendments to Official Gazette, Enforcement Laws

Amman, Dec. 3 (Petra) – The Lower of House of Parliament on Wednesday approved, by majority vote, two draft amendments: the 2025 Official Gazette Law and the 2025 Legal Enforcement Law.

The amendment to the Official Gazette Law authorizes the Prime Minister to determine whether the Gazette is issued electronically or in print, depending on need. According to the explanatory memorandum, the amendment seeks to align the Gazette's publication process with legislative and technological developments, noting that the current law, enacted in 1949, requires modernization. The draft grants electronic publication the same legal standing as print publication, while permitting issuance outside the current periodic schedule when necessary.

Regarding the Legal Enforcement Law, the amendment introduces the option of electronic monitoring for individuals sentenced to imprisonment, at the request of the judgment creditor and upon a decision by the head of enforcement, if deemed beneficial.

The draft aims to streamline enforcement procedures, expedite the delivery of rights, allow sentenced individuals to maintain employment to meet their obligations, reduce reliance on imprisonment where possible, and enhance enforcement mechanisms.

The Legal parliamentary committee’s reformulated provision states: "Notwithstanding the provisions of this article, the head of enforcement may, upon the judgment creditor’s request for imprisonment of the judgment debtor or after a judgment of imprisonment has been issued, subject the judgment debtor to electronic monitoring at the creditor’s request if deemed beneficial, provided that the monitoring period does not exceed the number of imprisonment days stipulated in this article for a single debt, and without affecting the total number of imprisonment days under this law. The judgment debtor may be subjected to electronic monitoring once more per year for a single debt if presenting reasons acceptable to the head of enforcement. Terms and conditions of electronic monitoring shall be determined by regulations issued for this purpose." Minister of Justice Bassam Talhouni said the amendment preserves the rights of judgment debtors and offers them an additional opportunity to work and repay their debts, noting that the repayment provisions in the draft are already reflected in the Civil Code.
